BAFT MPA Legal Opinions

ITFA is pleased to announce that new legal opinions, issued by Sullivan & Worcester and covering the following documents, are now available to ITFA and BAFT members:

• BAFT English law MPA – 2018 (“equitable assignment” basis)
• BAFT English law MPA – 2008 (“debtor/creditor” basis)
• BAFT New York law MPA – 2019

Please note that only ITFA members can view these documents, which can be found in the member area of the ITFA website.

The article 194 opinions relate to the enforceability of the BAFT MPAs and the manner in which they satisfy the Capital Requirements Regulation (CRR) criteria.
 
This continues our efforts to support ITFA members, who are legally entitled to rely on the opinions.
