Adoption of MLETR – a legal perspective and world tour

The development of technologies over the past decade has made paperless trade increasingly attainable. Recently, the disruption caused to supply chains by the COVID-19 pandemic has highlighted the gulf that now exists in many jurisdictions between what is technically possible and what is legally permitted or recognised in relation to the transferable records that underpin international trade.

Globally efforts are being made to address the lag in legal recognition of electronic documents. ITFA tracks those efforts via the Technology Experts for Regulatory Action (TERA) task force which we set up at the start of the pandemic and which comprises banking, legal and technology experts. ITFA also supports those global digitization efforts through our DNI Initiative which delivers a MLETR-compliant technology stack embedding both DLT and e-signatures.
 
By adopting the Model Law for Electronic Transferrable Records (MLETR), governments can help private parties overcome the requirement that certain negotiable instruments be presented in hard-copy format where the requirements for a functionally equivalent electronically transferable record are met. Which countries are effectively aligning with MLETR? What is expected in the G7 countries? How can banks prepare? How is ITFA DNI Initiative helping the industry accelerate adoption? What is the role of law firms?
